dont think it looks similar, i just think u think it looks like some of their work, at lower quality of course

I think the design is dependant on the type of site...
The site looks alright for a music related site or homepage... but personally I wouldn't use it for selling chemical supplies or special services to the blind (heh)

Looks like your site would be heavily based on graphics... This again could be an issue in the modern age of web development... with the movement towards XHTML and Accessability, your graphical design could struggle with some browsers.

Just some things to consider when designing =)

Overal great layout... I assume the navigational would be straight forward (can't tell though)... colour scheme all matches...

i was intending to use it on a music site which i have to make for one of my friends...thanks for the feedback tough

Not sure if you are still looking for feedback or not, but
I would say that some color additions and corrections might make a big difference. I really love the thin fire orange box at the top. Having a deeper royal blue box at the bottom would help to bring things together. If this is for a music site, I would try to find another basic background color besides grey. Music at its best is pulsing with life. Use some colors that remind people of life, yellow, green, brown...and let me know.
